1. Introduction
These Terms and Conditions ("Terms") govern all bookings, purchases, and participation in
tours, attractions, activities, transportation services, and related tourism services offered by
PRAGUE AND FLY ("Company", "we", "our", or "us").
By making a booking through our website, by phone, by email, through social media, or any
other booking channel, you acknowledge that you have read, understood, and agreed to
these Terms.
2. Booking and Payment

All reservations are subject to availability and confirmation by the Company.

Full payment is required at the time of booking unless otherwise agreed in writing.

A booking is considered confirmed only after full payment has been received and a confirmation has been issued by the Company.

The Company reserves the right to refuse, cancel, or modify any booking if payment is not successfully completed.
3. Services
The Company provides tourism-related services, including but not limited to:

Guided tours

Sightseeing activities
-
Transportation arrangements
-
Attraction tickets
-
Private and group experiences
-
Airport transfers
-
Customized tourism packages
Service descriptions, durations, itineraries, and schedules are subject to change due to
operational requirements, weather conditions, supplier availability, safety considerations, or
circumstances beyond the Company's control.
4. Customer Responsibilities
Customers are responsible for:

Providing accurate personal and contact information.

Arriving at the designated meeting point on time.

Ensuring they possess valid travel documents where required.

Following all safety instructions and local regulations.

Respecting guides, staff members, other participants, and property.
The Company shall not be responsible for missed services resulting from late arrival,
incorrect information provided by the customer, or failure to follow instructions.
5. Cancellation Policy
Customer Cancellations:
Cancellation requests must be submitted in writing via email, WhatsApp, or another
approved communication channel.
The following cancellation terms apply:

More than 72 hours before the scheduled activity or service: Full refund (100%).

Between 72 hours and 24 hours before the scheduled activity or service: 50% refund.

Less than 24 hours before the scheduled activity or service: No refund.

No-show or failure to attend: No refund.
Refunds will be processed using the original payment method whenever possible.
6. Rescheduling Policy
Customers may request to reschedule a booking.

Rescheduling requests are subject to availability.

The Company will make reasonable efforts to accommodate date changes.

Approval of a rescheduling request is at the sole discretion of the Company.

Additional charges may apply if the new booking date involves higher costs or different service conditions.
7. Company Cancellations
The Company reserves the right to cancel, postpone, modify, or reschedule services due to:

Weather conditions

Safety concerns
-
Insufficient participation
-
Technical or operational issues
-
Government restrictions
-
Force majeure events

Circumstances beyond the Company's reasonable control In such cases, customers may choose one of the following options:

Rescheduling to an alternative date;

Receiving a credit for future services; or

Receiving a full refund for the affected service.
8. Force Majeure
The Company shall not be liable for delays, interruptions, changes, or cancellations caused
by events beyond its reasonable control, including but not limited to:

Natural disasters

Severe weather conditions

Epidemics or pandemics

Government actions or restrictions
-
Strikes or labor disputes

Transportation disruptions

Acts of terrorism

Civil unrest
9. Limitation of Liability
To the fullest extent permitted by applicable law:

Participation in tours and activities is at the customer's own risk.

The Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages.

The Company shall not be responsible for loss, theft, or damage to personal belongings.

The Company's total liability shall not exceed the amount paid by the customer for the affected service.
10. Health and Safety
Customers are responsible for ensuring that they are physically and medically fit to
participate in the booked activity.
The Company reserves the right to refuse participation to any individual whose behavior,
condition, or actions may endanger themselves, other participants, staff members, or
property.
11. Privacy
Personal information collected by the Company will be used solely for booking management,
customer service, operational purposes, and legal compliance.
The Company will process personal data in accordance with applicable data protection laws,
including the General Data Protection Regulation (GDPR) where applicable.
12. Intellectual Property
All content displayed on the Company's website, marketing materials, photographs, logos,
text, and branding remains the property of PRAGUE AND FLY and may not be copied,
reproduced, or distributed without prior written consent.
13. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the
laws of the Czech Republic.
Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the
competent courts of the Czech Republic.
14. Agency and Intermediary Services Disclaimer
PRAGUE AND FLY acts solely as an intermediary and booking agent between
customers and independent third-party service providers, including but not limited to
tour operators, transportation companies, activity providers, attractions, guides, and
other tourism-related suppliers.
While PRAGUE AND FLY carefully selects its partners and strives to ensure a high standard
of service, the actual services are provided by independent third parties who are solely
responsible for their performance, operation, safety standards, schedules, policies, and
service delivery.
PRAGUE AND FLY shall not be liable for any injury, loss, damage, delay, cancellation,
accident, omission, service failure, change of itinerary, or any other event arising from the
acts, omissions, negligence, or defaults of any third-party service provider.
Any claims relating to the quality, execution, safety, or performance of a specific service shall
be directed to the relevant service provider responsible for delivering that service.
By completing a booking, the customer acknowledges and agrees that PRAGUE AND FLY's
role is limited to facilitating reservations, coordinating services, and processing payments on
behalf of independent service providers, and that PRAGUE AND FLY is not the direct
provider of the booked services unless explicitly stated otherwise.
For the avoidance of doubt, PRAGUE AND FLY does not assume liability beyond its role as
an intermediary and facilitator of travel and tourism-related services.
15. Consumer Rights
Nothing in these Terms and Conditions limits or excludes any mandatory consumer rights
provided under the laws of the Czech Republic or applicable European Union legislation.
If any provision of these Terms is found to be invalid or unenforceable, the remaining
provisions shall remain in full force and effect.
